The BUYER confirms that this information is correct and current. It is stored with the order and sent to the BUYER in the order confirmation email.

2. Definitions

  • Product: intangible goods delivered electronically on venus.tr: WHMCS and WiseCP themes, scripts, addons, modules and similar software files and their documentation.
  • Ready-made product: themes and scripts offered with a price on a product page, bought through the checkout page and delivered without changes.
  • Custom order: custom development, adaptation, installation and similar work done at the BUYER’s request.
  • License domain: the internet domain the BUYER enters during the order, on which the product will be installed and used.
  • Delivery: sending the product’s download link to the BUYER’s email address.
  • Law: Turkish Consumer Protection Law No. 6502. Regulation: Distance Contracts Regulation.

3. Subject

This agreement sets out the rights and obligations of the parties regarding the sale and delivery of the product ordered electronically on venus.tr, under the Law and the Regulation.

4. Product, price and payment

  1. The product’s name, type, main features and price are shown on the product page and in the order summary on the checkout page. The amount in the order summary is the total amount charged to the BUYER.
  2. Payment is made by credit or debit card through the licensed payment institution PayTR Ödeme ve Elektronik Para Kuruluşu A.Ş. Card details are not passed to or stored by the SELLER.
  3. Instalment options depend on the card issuer and the payment institution. Any instalment charge is shown to the BUYER on the payment screen.
  4. The SELLER may change prices on the product page until the order is confirmed. The price of a confirmed order does not change.
  5. If payment fails or is cancelled by the bank for any reason, no delivery obligation arises.

5. Delivery

  1. The product is not shipped physically and there is no shipping fee. When the payment institution confirms payment, the download link is sent automatically to the email address in the order form.
  2. The delivery time guarantee applies to ready-made products only. If automatic delivery of a ready-made product fails for a technical reason, the SELLER delivers within 3 business days of payment confirmation. Delivery never exceeds the statutory 30 days.
  3. No delivery time is guaranteed for custom orders. Times the SELLER gives for such work are estimates and may change with the scope, the BUYER providing the needed information and content on time, and third-party systems.
  4. For security the download link is time-limited and can be used a limited number of times. If it expires, the BUYER may request a new link.
  5. The SELLER is not responsible for delays caused by a wrong email address; on request, after verifying identity and the order, the SELLER delivers again.

Details are in the delivery terms.

6. License

The product grants the BUYER a right of use (license), not ownership. It may be used on one license domain entered at checkout; the license does not cover subdomains. Unless the product page says otherwise, the license domain cannot be changed later. Terms of use, modification, the ban on resale and updates are set out in the license terms, which form part of this agreement.

7. Right of withdrawal

  1. Under Article 15(1)(ğ) of the Regulation, the right of withdrawal does not apply to contracts for services performed instantly in electronic form or intangible goods delivered instantly to the consumer. The products sold are in this scope.
  2. At checkout the BUYER separately confirms knowing that the product is digital content, that delivery starts upon payment confirmation and that the right of withdrawal is therefore lost. This confirmation is stored with its date and time.
  3. As the products are digital and licensed, no product returns or refunds are made after delivery. This does not affect the case where the product could not be delivered at all for a reason on the SELLER’s side, nor rights that cannot be limited by contract under the law. See cancellation, refund and withdrawal.

8. Defective products and support

  1. If the product lacks the features stated on the product page or differs materially from its demo, the BUYER reports the problem in writing by email or WhatsApp within a reasonable time after delivery.
  2. The SELLER fixes it by sending a corrected file or making the necessary fix. As the products are digital and licensed, the remedy for defects is a fix; no refund is made. Rights that cannot be limited by contract under the law remain.
  3. Incompatibility with the BUYER’s server, third-party addons or WHMCS/WiseCP versions outside those supported, changes made by the BUYER and problems caused by the hosting environment are not defects.
  4. Installation and customisation services are not included in the price and are quoted separately.

9. Rights and obligations

  1. The SELLER delivers the product in line with this agreement and the product page.
  2. The BUYER uses the product under the license terms, does not share the product files with third parties and enters the license domain correctly.
  3. If the BUYER breaches the license terms, the SELLER may terminate the license and support without refund.
  4. For corporate (merchant) buyers, consumer-specific provisions of the Law do not apply; the Turkish Code of Obligations No. 6098 and Turkish Commercial Code No. 6102 apply.

10. Invoice

The invoice is issued electronically (e-Arşiv) with the billing details in the order form and sent to the BUYER’s email address.

11. Personal data

Personal data is processed under Law No. 6698 (KVKK) for the purposes and periods in the privacy notice.

12. Disputes

  1. Consumer arbitration committees at the BUYER’s place of residence or of the transaction have jurisdiction within the monetary limits announced yearly by the Ministry of Trade; consumer courts have jurisdiction above those limits.
  2. For corporate purchases, the courts and enforcement offices of İstanbul (Anatolia) have jurisdiction.

13. Effect

The BUYER confirms having read, understood and electronically approved the preliminary information form and this agreement at checkout. The agreement takes effect when payment is completed. The approved version is stored with the order and sent with the confirmation email.
